1. AGREEMENT TO TERMS

By accessing or using our website, www.smilensure.com (the “Site”), you agree to be bound by these Terms & Conditions. If you do not agree with all of these terms, you are prohibited from using the Site and must discontinue use immediately.

2. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site is our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by SmileEnsure.

3. USER REPRESENTATIONS

By using the Site, you represent and warrant that:

  • You have the legal capacity and you agree to comply with these Terms & Conditions.

  • You are not a minor in the jurisdiction in which you reside.

  • You will not access the Site through automated or non-human means (bots, scripts, etc.).

  • Your use of the Site will not violate any applicable law or regulation.

4. PRODUCTS & PAYMENTS

  • Availability: All products are subject to availability. We reserve the right to discontinue any products at any time for any reason.

  • Pricing: Prices for all products are subject to change. For global customers, prices may be displayed in different currencies, but the final transaction may be processed in a specific currency (INR/USD) as per our payment gateway.

  • Payment: You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. We use secure third-party payment gateways; we do not store your full credit card details.

5. GLOBAL ORDERS & SHIPPING

  • Export Controls: Products are shipped from Ahmedabad, India. It is your responsibility to ensure the product can be lawfully imported to the destination country.

  • Transfer of Title: The risk of loss and title for items purchased by you pass to you upon our delivery to the carrier.

  • Customs: International orders may be subject to import duties and taxes, which are levied once a shipment reaches your country. You are responsible for these charges.

6. PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make the Site available. Prohibited activity includes:

  • Systematically retrieving data to create a collection, compilation, or database.

  • Circumventing, disabling, or interfering with security-related features of the Site.

These Terms shall be governed by and defined following the laws of India. SmileEnsure and yourself irrevocably consent that the courts of Ahmedabad, Gujarat, India shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

9. BINDING ARBITRATION

Any dispute arising out of or in connection with this contract shall be referred to and finally resolved by arbitration under the Indian Arbitration and Conciliation Act. The seat of arbitration shall be Ahmedabad, India.
